O caráter arbitrário de tal hermenêutica é evidente, pois pretende sequestrar o direito, tornando-o cativo de certos grupos minoritários e eliminando o primado do Estado de Direito, segundo o qual todos são iguais perante a lei.
Esses movimentos entendem que a lei foi feita apenas para proteger o que eles chamam de “burguesia”, razão pela qual defendem que ignorar ou mesmo violar essa lei é um ato libertador, especialmente quando se trata de ocupar o que eles consideram ser o “espaço público” – ato em nome do qual sistematicamente transformam em um inferno a vida de quem não tem nada com isso.
Quem contesta esse estado de coisas é desde logo qualificado de “reacionário” e exposto nas redes sociais como inimigo dos pobres ou da cultura. O que pode um cidadão comum fazer contra tão poderoso movimento?
O ex-auxiliar de enfermagem João Batista da Silva, de 70 anos, decidiu enfrentar sozinho, como um quixote, essa onda autoritária. Morador há décadas de uma casa no chamado Beco do Batman, na Vila Madalena, transformado em atração turística paulistana em razão da profusão de grafites desenhados em suas paredes, resolveu pintar o muro de sua casa de cinza, apagando as obras ali expostas. Seu ato foi gravado em vídeo por um grafiteiro e causou furor ao ser veiculado na internet.

O fato de o muro não ser público, e sim parte da propriedade de João Batista, não pareceu importante. Ao contrário: para quem se julga com poder de estabelecer o que é “espaço público”, o conceito de propriedade privada é obviamente irrelevante.
Com a repercussão do caso, João Batista esclareceu o objetivo de seu gesto. Foi uma maneira de chamar a atenção do poder público e da imprensa para o tormento diário que ele e seus vizinhos enfrentam desde que o Beco do Batman se transformou em atração turística, indicada inclusive pela Prefeitura. Os turistas que por ali passam, atraídos pelos grafites, não se limitam a observar as obras.
Segundo contou o cansado João Batista, a algazarra dos visitantes tirou o sossego dos moradores. Há quem ali faça suas necessidades na rua, toque música no último volume até altas horas da madrugada e consuma drogas e bebidas alcoólicas em grandes proporções. Se os moradores reclamam, invariavelmente são xingados por essa vanguarda cultural.
Ou seja, o problema do cidadão João Batista não eram os grafites, dos quais gostava e com os quais convivia havia mais de 20 anos, mas sim a incivilidade dos que se julgam donos do tal “espaço público”. “Isso aqui está em um estado deplorável. Não é por causa dos grafites. O problema é que as pessoas ficam a noite toda aqui. Usavam o meu portão de poleiro”, contou João Batista.
A reivindicação de João Batista era tão natural que até alguns grafiteiros disseram compreender seu problema. Um deles disse que o Beco do Batman “virou um caos” e que “as pessoas não respeitam os moradores”. Outro comentou que certamente João Batista foi movido por “desespero” e que está “no direito dele”.
O protesto de João Batista funcionou. A Prefeitura enviou um representante para conversar com ele e se dispôs a estudar as mudanças sugeridas pelos moradores, como melhorar a limpeza do local e restringir o acesso à noite. Afinal, João Batista e seus vizinhos, que não acharam o direito na rua, só querem dormir em paz”.
